Via Cookies, Logs, and Automated Mechanisms:

Similar to many website operators, KubeBits gathers information typically made available by web browsers and servers through commonly used data collection tools like cookies (refer to Section 4, "Cookie Usage," for more information). This data includes the visitor's browser type, language preference, referring site, physical location, additional websites requested, and the date and time of each request. We also collect potentially personally-identifying information such as Internet Protocol (IP) addresses. ApeCloud provides a database management service enabling Users to utilize their own data within our Service ("Customer Data"). We do not determine or control the nature of data processed by our Users through the Service, nor their processing methods. Should Users input or upload Customer Data containing personal information to the ApeCloud platform, we function as a data processor, handling such information solely on the User's behalf and per their instructions. We utilize Customer Data to:

• Deliver and operate the Service for the User

• Address and prevent service or technical problems

• Fulfill User requests, instructions, or support needs

• Serve other purposes outlined in our agreement with the User, or as mandated by law

In these instances, the User (or relevant third parties collaborating with the User) retains responsibility for managing personal information and ensuring compliance with applicable data privacy laws. For inquiries or concerns regarding the handling of such personal information, please contact the entity utilizing our Service and consult their respective privacy policies.

2. Utilization of Collected Information

We use your information for the following purposes:

• To deliver the Service pursuant to our agreement with you.

• Where we have a legitimate interest, to optimize our Service offerings and inform you about other products, services, and promotions.

For example, ApeCloud may use provided information to communicate Service-related updates, promotions, or events; offer technical support; solicit feedback on our Service; or notify you of policy changes. You can manage your communication preferences by using the unsubscribe link in ApeCloud emails or adjusting notification settings in your User Profile Settings panel. Alternatively, direct your preferences to support@apecloud.com. Opting out may result in not receiving communications about potential improvements or offers; however, you cannot opt out of essential Service-related emails (e.g., planned downtime, feature updates, security alerts).

3. Information Sharing Practices

• General Policy: We do not disclose User Personal Information externally, except as described herein or in Section 7, "Compelled Disclosure."
• Employees and Service Providers: ApeCloud discloses User Personal Information only to employees, contractors, and affiliated organizations who: a. Require the information to process it on our behalf or to provide/improve our Service, and b. Have committed not to disclose it further, except as legally required. Such entities may include email service providers, hosting providers, and payment processors. Some may be located outside your home country; using ApeCloud' Service implies consent to such transfers. Refer to Section 5 for additional details.
• Business Transfers: ApeCloud may share or transfer User Personal Information if involved in a merger, sale, or acquisition. Should such an event occur, we will maintain the confidentiality of User Personal Information and provide notice prior to any transfer. The acquiring entity must uphold the commitments made in this Privacy Statement and our Terms of Use.
• Advertising: ApeCloud does not host third-party advertising on its website, nor do we share, sell, rent, or trade User Personal Information with third parties for their direct marketing purposes.
• Do Not Track (DNT): DNT is a browser setting indicating your preference against online activity tracking. As there is no universal standard for DNT signals, ApeCloud has not implemented a specific DNT method and does not respond to browser DNT settings. We do not track your activity across other web services nor permit third-party tracking on our site. Should a universal standard emerge, we will reevaluate this policy.
• Aggregated Data: ApeCloud may disclose aggregated, non-personally identifying information without restriction, such as statistics on collective Service usage, to share general insights about our Service.

Data Security Standards:

ApeCloud implements all reasonably necessary measures to protect User Personal Information from unauthorized access, alteration, or destruction; maintain data accuracy; and ensure appropriate use. We adhere to generally accepted industry standards for protecting submitted personal information during transmission and upon receipt. Note that no transmission method or electronic storage is 100% secure, and thus we cannot guarantee absolute security.

Third-Party Provider Security:

While we take reasonable steps to ensure affiliated organizations maintain confidentiality and security, their practices are ultimately beyond our control. Using our Service implies acknowledgment and assumption of these risks. International Data Transfers:

Collected information may be stored, processed, and transferred among any countries where we operate to enable use in accordance with this Privacy Policy. Refer to the section below regarding data transfers outside the EEA.

6. Data Transfers Outside the EEA

For residents of the European Union, please note that as we are based in the United States, providing User Personal Information entails processing in countries outside the European Economic Area ("EEA"), such as the United States, which may not offer equivalent data protection levels. This transfer is necessary for Service performance. Regardless of location, we implement the measures outlined in this Privacy Policy to protect your Personal Information.

ApeCloud discloses potentially personally-identifying and personally-identifying information only in response to a subpoena, court order, governmental request, or when we believe in good faith that disclosure is reasonably necessary to protect the property or rights of ApeCloud, third parties, or the public. In complying with legal processes, we aim for transparency and will, when permitted, make reasonable efforts to notify Users of such disclosures.

8. Your Rights and Control Over Collected Information

Access to User Information:

As an ApeCloud User, you can access, update, modify, or delete basic profile information via your user profile settings or by contacting support@apecloud.com. Note that certain information is necessary for service provision. You may discontinue service use at any time.

Data Retention:

Upon User account termination or deactivation:

a. We may retain User Personal Information for a commercially reasonable period for backup, archival, contract performance, enforcement, or audit purposes.

b. We will promptly delete or return all personal Customer Data and existing copies, unless further retention is required or authorized by law.

Deletion of User Information:

To cancel your account, delete User Personal Information, or request cessation of data use for Service provision, contact support@apecloud.com. We may retain and use information as necessary to comply with legal obligations, resolve disputes, and enforce agreements.

Control of Communications:

ApeCloud may periodically email Users about new features, solicit feedback, announce significant changes, or provide updates. Manage these communications via the unsubscribe link in emails or notification settings in your User Profile. Requests can also be sent to support@apecloud.com. Note that opting out of promotional communications does not affect essential administrative or Service-related emails.

Cookie Controls:

Most browsers allow cookie notification and restriction settings. Disabling cookies may impact Service features reliant on cookies for functionality.

Local Shared Objects ("Flash Cookies"):

We may use other local storage types, similar to cookies but stored differently, including Flash cookies via the Adobe Flash plug-in. Browsers may allow disabling HTML5 local storage or deleting contained data. Refer to provided links for details on managing "local shared objects."
